Speaking during an interview with a weekend newspaper, Silva has said
that Yoshitha Rajapaksa was linked to the recent assault of Malaka
Silva at a night club as well as an earlier assault on him at the Odel
car park.
The most recent clash had triggered after Malaka had given a bit of advice to one of Yoshitha's guards, Mervyn Silva has said.
Noting that the former President had only learnt of this incident at
the last minute, Silva said that Mahinda Rajapaksa had visited Malaka
within 45 minutes since the incident had occurred.
The Nawaloka Hospital, where Malaka was treated, had not even
accepted the payment of the hospital bill, the former minister added.
Silva has also revealed that security cameras recording the clash were jammed.

Minister Minister Mervyn Silva said 12 men had attempted to abduct his son Malaka this evening and that he was injured during the fracas at the ODEL car park in Town Hall.
When asked by journalists about the injuries suffered by his son, the minister responded by saying, ‘Why? Are you a doctor?’
“I was at home when my son called me and said 12 unidentified men had assaulted him and that he had fought back. I told him to get himself admitted to hospital and allow the police to carry out their investigations,” he said.
“Police are carrying out investigations. When 12 people assault one person obviously he is bound to get injured. But I am happy that he is in a stable condition. This could have ended up at the mortuary but I am happy he is stable”, he said
The minister said the biggest question is why 12 people should assault him.
When a journalist asked him whether he was was aware that such an incident might happen, he said if he knew he won’t be here talking to the media.
“My brother, sister and brother-in-law were killed by the JVP-UNP. Go to Tissamaharama and ask how many of the murderers are still alive,” the minister said.
Before leaving to ODEL he asked the journalists, ‘Why are you asking me about his wounds”.
The police emergency unit rushed to the scene after receiving a 119 call from an eyewitness to the incident. According to eyewitnesses Malaka had received several blows to his head.
He was admitted to the Nawaloka Hospital shortly afterwards. Several senior police officers arrived at the scene but the miscreants had left by then.
Detectives recorded a statement from one of the eyewitness who is believed to be a security guard of the clothing store. They are also expected to examine the CCTV camera footage as well.

I am frustrated and mentally depressed - Malaka Silva
Minister Mervyn Silva’s son Malaka Silva said he is very frustrated and mentally depressed due to the behavior of the media in the country.
“I am in a very frustrated and mentally depressed state. Rural youths have chances to go to conciliation board and settle matters relating to minor disputes.
But we are always being attacked by all. I have also been subjected to physical and mental pain,” he said in an interview.
Q: Are you a bandit? Why do you always get involved in brawls?
I am not a bandit. These brawls are not pre planned, they keep coming to me. I try to keep away from getting into trouble. It is not only me; any youth has a limit to patience. I am not an arahath or a god. I am only a human being.
Q: But from what we have heard you don’t keep to yourself.
Reason is this. I am the son of Minister Mervyn Silva. The media is always following me. If I am found at someplace whenever something happens, the media makes capital out of it. Then they say Malaka has some connection to the incident. The best example is the incident that happened recently. The media fabricated a big story. When the incident occurred I was inside my car. It can be proved with the video. I was not there at that time. Media always said Minister’s son Malaka assaulted. Only thing I was nearly when the incident occurred. If I was not there no such incident may occur. They have given the publicity claiming Malaka assaulted. What really happened was revealed by that officer. He said I did not assault him at all. I was remanded by the media.
Q: Are you saying that you have not done anything wrong.
Yes, I did nothing wrong.
Q: Has your father who is a Minister given you the security personnel he has?
That is a wrong statement. I have no security personnel.
Q: Then why is there such a big crowd with you?
I have many good friends.
Q: What kinds of friends?
No one special. I am not so selective. Some of them are rich, while some of them are poor.
Q: Why do you have so many friends around you?
I wish to enter politics, so I must have lots of friends whether they are from poor or rich families. To do politics we need money and I think rich friends are very helpful in politics. I always try to find solutions for problems faced by my friends. They are not bandits, and they are not members of the underworld and they are only our political supporters and voters. I don’t want to avoid them. I need them for my politics. We do not commit murder or any bad things. I don’t understand why the media is trying to show me in this manner. That is why I am reluctant to give interviews to the media.
Q: Many people regard you as a youth who is always associated with club goers and drug addicts. And you try to live like an American.
There are clubs in many countries in the world except in Arab countries. Today society is very different from ancient society. Today youth prefer to enjoy KFC and MacDonald’s foods instead of jak fruit and bread fruit. I am also this kind of persons.
Q: You mean you are a regular club goer.
I used to go to clubs frequently but now I visit clubs very seldom. When I feel I need a change I will go to a club. My answer to your question about drugs I do not take any drugs. I take red wine nothing else. Media has painted me as a drug user. There was an incident of using my name in a story of drugs relating to another person who was taken into custody by the Narcotics Bureau. I don’t know why the media behaves in this manner. By looking at a person’s behavior you can know whether he or she is a drug addict. Do you see me as such addict. As I wish to enter politics I don’t want to involve in this type of anti- social activities.
Q: Are there female friends among your associates?
Yes I have girls among my friends. But my friends are very decent. I don’t see any wrong in associating with girls.
Q: There are sons of many ministers who are your age. But they are different and they don’t patronise clubs.
I have already told that I was not a frequent club goer. You can go to clubs and have a good view of the sons you mention. The problem is the media. They are very selective in reporting about these incidents. Society is different. Youth in rural areas don’t go to clubs but urban youths do. There is nothing abnormal about it. But the problem here is with Malaka only because he is Minister Mervyn’s son.
Q: Don’t you think that your present behaviour is an obstacle for your future?
Unfortunately media look at us only from one angle. They don’t see us positively. Police, Courts, Hospitals are the places the media reports when it is linked with me. If I push a man in defense and he gets injured the media will report me as a thug who has smashed a head of an innocent man. I don’t take these things seriously.
Q: Don’t your family members blame you for this type of behavior.
Father always warns me and says that he won’t get involved in any of my problems. And he doesn’t seek help from others for my affairs. He doesn’t like my friends visiting me. He is very strict.
Q: But your family members came to court.
Yes as family members they came to court. They know I was not a criminal and offered their help as family members.
Q: Don’t you like to stay free of these troubles?
I have already told you that I don’t create problems. Some always try to link me with problems. I don’t want to get involved in any incidents. I always tend to help others to the best of my ability.
Q: How do you feel about this type of incidents?
I am frustrated. That is why I am leaving the country as I did on a previous occasion too. I am innocent. I have been charged for what I have not done. And it is intolerable.
Q: How do you see yourself?
All are not entirely correct. Look at us positively too and show any wrongs so I can correct them. I am a free man. I like to enjoy a simple life.
Q: Have you any message for readers?
Even your paper has seen only the bad side of my character. I remember former President R. Premadasa saying, “Kill me, but not my reputation”. I am in a very frustrated and mentally depressed state. Rural youths have chances to go to the conciliation board and get settlement for their minor disputes. But we are always being attacked by all. I have also been subjected to physical injuries and mental pain.

Malaka released
Malaka Silva and Rehan Wijeratne, who were remanded on Monday for allegedly assaulting an army major, were released by the Colombo Fort Magistrate today on bail with two sureties of Rs 1 million each .
Army Major Chandana Pradeep Susena, who is a witness in an assault case, was questioned by Magistrate Kansihka Wijeratne before the two suspects in this case was released on bail. The Magistrate asked major why he recanted on his earlier statement that the two suspects had assaulted him.
The major responded saying he was under shock at the time he made his complaint to the police. The Magistrate asked him how an army intelligence unit officer with more than 15 years of service could suffer from shock. Then the major said it happened because he was bleeding and traumatised at the time.
The Magistrate said even though a settlement had been reached between the two parties, would not be considered as over because of the robbery charge that is still pending.
He directed the police to investigate the matters mentioned in the complaint made by the army major and also check the CCTV footage on the incident before they submitted their report to court on September 24.
The police were also directed to tell court the action that would be taken against the army major

Malaka didn’t assault me - Army Major
The lawyer of the Army Major, who was injured during a brawl at JAIC Hilton Colombo, filed an affidavit before the Colombo Fort Magistrate today stating that Malaka Silva and Rehan Wijeratne did not assault him.
The affidavit also stated that five others, who are in the remand prison, have assaulted him and also agreed to settle the matter amicably. In his motion before Colombo Fort Magistrate Kanishka Wijeratne, counsel Dinesh D. Dodamgoda appearing for the aggrieved party informed that his client Major Chandana Pradeep Susena had decided to arrive at an amicable settlement with the consent of both parties.
According to the affidavit attested by Commissioner of Oaths R.S.A. Kottelawala, the complainant said though Malaka Silva and Rehan Wijeratne were present at the hotel, they were not involved in assaulting him and even did not aid or abet in the commission of the offence. He said some of the others who were at the hotel might have assaulted him.
The army major said the lawyers of the two parties would discuss the settlement.
The Major said that though he had alleged that his gold chain was robbed by someone at the hotel he had later found it at his residence.
Filing a motion, counsel Dodamgoda moved Court that the case be taken up tomorrow and notice be issued on the complainant party to appear in Court. Having considered the submissions, the Magistrate ordered the Court Registrar to issue notice on Major Chandana Pradeep Susena through the Commanding Officer of the Army Hospital requesting that he appears in court on September 24.

On the following day, the driver of Malaka
Silva handed over the firearm and ammunition to Slave Island police, but

Malaka remanded until Sept 24
Malaka Silva, Rehan Wijeratne and five others were ordered to be remanded till September 24 by Colombo Fort Magistrate Kanishka Wijeratne.
They were produced in Court over the alleged assault on an army officer. The Magistrate also directed that they be produced at an identification parade on the same day.
In their report to Court the police levelled strong allegations against the seven suspects and moved Court to have them remanded till October 1 because according to witnesses the suspects had been involved in the assault on Major Susena.
Colombo Crimes Division (CCD) SSP D.R.L. Ranaweera told Court that only the first accused Malaka and the second accused Rehan were being produced in open Court because they had been identified by the complainant. He said the five other suspects would be produced at an identification parade.
SSP Ranaweera said at about 3.00 a.m. on September 9, ten suspects including Malaka Silva had assaulted the Army Major after robbing his service revolver, mobile phone and car key.

My Son Malaka is not in hiding - Mervin Silva
Mr. Sarath Fonseka has challenged me to produce Malak Silva who is supposed to be hiding to the Police, but before issuing such challenges, Mr Fonseka should produce his own son in law, who is being hidden by him, said Minister Mr. Mervin Silva.
He was speaking at a press briefing
today (14) where he reiterated that his son was not in hiding and the
police if necessary could come anytime and take him into custody, he
said.
The Minister also said his son was not a murderer, drug peddler, bribe taker or another’s woman snatcher to go into hiding.
The incident of an alleged assault by Malaka Silva on an army Major, is not a big issue as made out by some media.
The Minister further said the incident
was one where there was a clash between friends in civvies. If his son
or any other person had assaulted any army personnel dressed in uniform,
it would have prompted him to immediately take the side of the army.
The Minister said he was unable to
disclose the real issue behind the incident since it would possibly
bring the army into disrepute. The assault was not an assault on the
army.
However, the army major who was subject
to an assault by Malaka Silva at a night club car park in Colombo
recently, is yet under medical treatment in the army hospital and has
even been operated on, it is reported.

Keheliya explains failure to arrest Malaka
Cabinet Spokesman Keheliya Rambukwella said on Thursday that Malaka Silva, the son of Minister Mervyn Silva who was wanted in connection with the assault on an Army major had not been arrested while he was at the Kelaniya Temple as the police would have felt that arresting him in the sacred precincts of the Kelaniya Temple was not proper.
“Police would have thought that arresting him in the presence of the Sacred Relics was not etiquette,” he said.
The minister was replying to a question by a journalist as to why the two special police teams that had been deployed to arrest Malaka Silva, had not arrested him when he was at the Kelaniya Temple.
Malaka Silva goes to Colombo DIG’s office
Malaka Silva, the son of minister Mervyn Silva and Rohan Wijeratne, the son of Sri Lankan ambassador in Turkey Bharati Wijeratne, have gone to the DIG’s office in Colombo this morning (Sept. 13) to give a statement with regard to an assault incident.
They are accused of having assaulted a
major attached to the Army intelligence and his buddy at JAIC Hilton
Hotel in Colombo a few nights ago.
The Army, on the instructions of the Army
chief yesterday, has set up a tribunal to investigate the incident, said
Army spokesman Brig. G. Ravipriya.
Meanwhile, the only sister of Dr. Nissanka
Wijeratne has refuted media reports that a son of the late minister was
involved in the assault incident. N. Hulangamuwa said Dr. Wijeratne had only two sons – Subodhana and Hasitha, who do not have anything to do with local politics.
Hasitha is a medical doctor who has
graduated from Hertfordshire University in England and presently serves
at Colchester Hospital. Sobodhana, an honours graduate of Cambridge University, England is reading for his doctorate in Japan, said Mrs. Hulangamuwa.
Their reputation has been tarnished by the
reports that a son of late Dr. Wijeratne had got involved in an act of
thuggery with a person like Malaka Silva, she said.
Upon further inquiries, it has been revealed that Rohan Wijeratne is a son of ambassador Wijeratne’s first marriage.
